Castle law is what I believe you are referring to?  I don't know.  That usually refers to inside the house.  Not outdoors.

This is a touchy topic.
Shooting a person isn't just about having the right to do so.  James handled it perfectly. He defused and bailed. And got his lady outa harms way.....
Another crappy thing to consider aside from Jims excellent point about collateral damage is once your weapon is discharged it's now evidence. And I hope all of you CCW folks have an umbrella insurance policy. Because if you survive the fight the legal battle will begin.

But really, only two problems in two events in what, 10 years? And no one was hurt...... You guys have an outstanding track record. And with all the booze consumed and no one has been injured that's impressive.
Hats off to you guys.

Any person over the age of 18 who is not prohibited from possessing firearms, and if otherwise
lawful, may keep and carry a firearm or have a firearm loaded at his or her place of residence,
temporary residence, campsite, or on private property owned or lawfully possessed by the person.
(Penal Code §§ 12026, 12031(h) and (l).) Any person engaged in any lawful business (including
nonprofit organizations) or any officer, employee, or agent authorized for lawful purposes connected
with the business may possess a loaded firearm within the place of business if that person is
over 18 years of age and not otherwise prohibited from possessing firearms. (Penal Code §§ 12026,
12031(h).)

What I provided is the CCW permit laws.  It's what the training class covers, it's what the interviewing detective will question you about, and it is what you sign when you are issued a CCW permit.  At least in El Dorado County.

Any differences between this and the quote on defense and self-defense is due to the concealed aspect of the weapon.  If you are carrying a concealed weapon without license to do so, then you were a criminal before the attack upon you. 

I would strenuously advise that no one carries concealed unless they are fully in compliance with the law to do so. 

Oh, one more thing that the CCW permit stipulates you can not carry your CCW if you are drinking alcohol.  So, sitting around a campfire with your buds and having a drink or two means you better not have the weapon on you at that time.

What about the fact that a campsite (your campsite) is considered an extension of your home?

You used good judgement in walking away. I'm glad it didn't escalate.

You can posses a gun in your campsite. It is your home. A while back the ban on guns in, I think, national parks, was over ruled because it is your home at that time. I'm not sure about concealed carry which you can do on your own property.

Trust me I know I made the right decision by walking away. This was not a fear thing at all but the best outcome for all decision.

This thread is not to tar and feather the member who brought this individual. It's to hopefully make it clear that this type of behavior is not tolerated at our events period. This is not only for friends of members but members as well as we keep growing.

I will kick back and tie one on with the best of you but in the end I'm out to have a good time and do not lose my head after having a few drinks. So if you are that type of individual who can't seem to control yourself after you've been drinking please either don't attend our events or stay the hell away from my camp!

I am not going to press charges on this person but I do not want to ever see him at another event. If I happen to see this person has made it into the forum I will make sure everyone knows who he is. But I am not going to give the name of the NCKA member out here.

PS I have been to many NCKA hookups and events and have never had a problem and I do not think that there is a growing issue. I just want to make sure that we don't start seeing more issues like this.

im not gonna comment on the gun conversation. But I tend to side with Jim. The cost of collateral damage is not one I'm willing to pay myself. Plus if I have one sip of alcohol I will not be armed so it wouldn't help me.

I was at your campsite that night James.
It was a typical chill, Nice fire , laughter , telling stories , hanging out with friends.
 I had left early just because that guy seemed to be asking for it and I didn't want to have to give it to him, so I went back back to my site and called it a night. It is very unfortunate that this has happened .

The self defense and CCW tangents are interesting and I'd like to flesh them out in another thread since this thrad should be about Rider's experience.  Suffice to say that most of what has been posted in this thread on those two topics is flat incorrect, conflates different distinct legal topics, and/or is not applicable in California.

I think its call attempted murder or assault with a deadly--Im no lawyer but  I think it  gets you free lodging for the weekend till the judge comes in on Monday-and loss of all camping gear and kayak over the cliff

That kind of behavior is unacceptable on any ncka event.  Not just to ncka members but also for kids, girlfriends and other family members who are around.  Gives these friendly tournaments a black eye.  :smt013
