I was so disgusted when I heard they were re allowing spear fishing again on the Ar so that's why I didn't chimme in on utter before...but now I'm so glad they made it official to not allow it...Thank god, the Mogans are Saved!!

I was under the impression that spearfishing SB in the AR is still legal.  Just not legal to have a speargun in the AR parkway.  Is that incorrect?

Does this mean you can't possess a speargun in the river of just the parkway.  I don't fish the AR so I'm clueless, but does the park system own the river or just the park?

It means no spearguns anywhere on the American River Parkway, to include the waterway. It's a weapon issue. Not a fishing issue. The spear fisherman were sorta screwed on it.
While I'm opposed to spear fishing for these fish I'm an outdoorsman just like they are. We all buy gear and liscences and want to put food on our tables.

I asked a warden that question once
Asked if I carried on a boat that put in on the Sac and navigated upstream on the AR without touching land would I be in violation of the Parkway laws.

He said yea and I would be cited and my firearm confiscated.
You can call FNG and run that scenario by them. Also call the park rangers who are actively enforcing any violations.

With the water levels where they are now there really isn't anyway to access the American River to spear a striper without entering through part of the parkway, therefore being in violation of the law. So any spearos in the water have and are breaking the law.

And there are fisherman along the banks and in drift boats watching the waterways. So really this thread is for our spear fishing brothers best interest to be aware of the laws so they don't get their gear confiscated. If I was in violation and a fellow angler, line or spear, educated me on my wrongdoing I'd be grateful. I don't want to have my gear confiscated or have to pay any fines.

I'm certain that a Park Ranger would enforce the ban on park property, however a Warden works for an agency that approves of spearing as a method of take and as far as I know it's not the Wardens duty to enforce County Ordinances. 

However, the AR, if it is navigable waterway, which the determination has to be made by the 9th circuit court, would be Federal jurisdiction which is not superceded by State Law or County ordinance.  Regardless if all the land under the water is state, county or privately owned, the watercourse belongs to the Federal Government.  Therefore it would be legal to pass through with a firearm or speargun.

To my knowledge, this issue has not been resolved except for the fact that you can't have a speargun in the parkway.

Those guys look like they couldn't be happier.  I bet those fish were full of roe too.

Most likely this time of year. Never ate one that size. Ate about a 17 pounder once that wasn't too good. I prefer the 7-12 pounders.

They look like they're about 30 lbs.  At least they didn't find the BIG fish.
