Sorry to hear your friend has to go thru this. Family law lawyering is unlike any other type of lawyering, it emanates from the bowls of the deepest and most satanic cesspool. The corruption in California Superior Court, Family Law Division, will gag a maggot across the street.

(1) Almost no one needs a lawyer for divorce in California. The whole system is set up to be DIY.  Every aspect of how custody is shared, property is divided, and support, if any, is paid is codified (already existing law). The “law” is fair, no one gets over on anyone, everything is divided equally. The same cannot be said for the lawyering that goes on in family court. There is literally no need for lawyers, but get just one lawyer involved and they can fuck that up quick, and they will, because that is how they justify getting paid in a system that does not require their services lawyering.

(2) Hiring a divorce lawyer is done for reasons of convenience and/or emotion. My advice is to think thru/past both of those reasons and NEVER hire a divorce lawyer in the county where the divorce is being heard. NEVER!!! ALWAYS only lawyer up for a divorce with a lawyer from another county.

If your friend is going to go with a lawyer, I very strongly suggest you point them toward a lawyer you know in the South Bay (Santa Clara Co), or at least for a lawyer from another county. Fwiw, filings are done electronically, lawyer could be anywhere in the state but being close enough to drive to their office would be a good thing.

ETA: I don't have an opinion on lawyers.  :smt003

Sigh.

You can safely ignore almost all of this.  Hiring out of county attorneys bar none is particularly terrible advice.

Ignorant, or a lawyer? There are only two options.

In the interest of helping the original poster helping his friend, can you tell us why you think getting a divorce lawyer from a county other than the county where the case is filed, is in anyway a “particularly terrible advice”?  :dontknow:

Because an attorney who knows and has a good reputation with  the judge, knows the local culture, knows the other attorney, and is regularly in that courtroom is far, far more likely to get you a good result at a lower cost than someone who doesn’t have those connections.

Basically, an out of town attorney stands a chance of getting hometowned by a local.

To be clear, most of the rest of what you said is dumb too.  But the out of county attorney advice could actively hurt someone who comes along and reads this and thinks it’s good advice.  It isn’t.

I love it. Legal advice on a kayak fishing board! Who knew this would be such a good use of my time.

And here I thought this was going to be another GWS thread...  :smt044
