Yeah, seems like you should be able to jump into the ocean and risk your own life if you want to; all us divers do it all the time. People do "stupid" things, doesn't mean a crime was committed.

if it was the guy's personal vessel, maybe.....but once a person is dependent on others to shoulder risk in order to save them it changes things.

OK, I don't know all the details, maybe the crew was in on it, maybe the water was glass calm... I dunno...however what I do know is
a captain's worst nightmare is hearing the words "man overboard". Having seen MOB drills on my wife's boat, they have to maneuver a heavy vessel into position to pick up the swimmer without running them over and killing them with the prop. In any kind of chop or wind it can be very difficult, and the difficulty only increases with the vessel size.
This kook who jumped not only put himself in danger, but basically gave the captain and crew a wicked jolt of adrenaline. Not to mention, no captain wants it on their record that a passenger died aboard their boat.

The more I think on it, I think the guy who jumped is lucky the coasties didn't hit him harder on the fine.

I bet that's what happened. He probably pissed off the crew enough to make them report it to the USCG. Looking into the story, it appears this type of infraction has only been issued a few rare times in the last decade or so.
 
“Commercial passenger vessel crews are responsible for the safety of all passengers aboard their vessels, and in this case, their attention was diverted away from the safe operation of the vessel when they were forced to retrieve the jumper from the water,” the Coast Guard said in a statement.

Or maybe the crew was just covering their asses. Because if they're "responsible for the safety of all passengers" then they are potentially liable for the guy who went into the water. He's a passenger too, right? Like they are just trying to avoid a fine themselves.
