OK guys and girls,

Don't know if everyone knows this....But, if you get fish from an other angler at the end of the day.  If that puts you over your daily limit.  Then, you need to get a note (letter) from this other angler.  Which states the day, the location, the other angler's address, phone numbers (home, cell, and work), their fishing lic. number and what they gave you and how many.  Because if you get caught with over limit.  They can take away your gear, yak and keep you from fishing for 3 years.  The person who gave you the fish will never be fine.  Only you.

I know this because of duck hunting for many years.  Duck hunting has a 2 day limit.  Most fishing I know around here is a daily limit.

An over limit is an over limit. Period. A note from your buddy will probably get a good laugh from a DFG officer.

You can.....It is like if you have more in  the freezer than the fish and game allows.  You can say that you gave them to your family.

Yep, you can give fish/abs to your family.  The difference is that you need a license to take but not to possess. That's why we have both take and possession limits.  More often than not, daily take limits are the same as possession limits.

I'll use ab diving in a few examples based on my understanding of all this.

Scenario 1:  Let's say you go ab diving with two friends, you each get a limit of abs (3), so now there are 9 abs among you. If your two friends take off and each hand you a note along with their abs and a warden stops you with 9 abs you're getting a big fat citation.   The notes aren't going to help you at all because you are well over your possession limit.

Scenario 2: You go camping with your wife for a couple days and she doesn't have a fishing license. On day one you get your daily limit of abs and gift them to your wife and on day two you get another 3 abs for yourself.  Now when the warden stops you on the highway on the way home you have 6 abs and one licensed ab diver.  However, the warden will notice on your ab card that the abs where taken on two different days and with two people and 6 abs all is well. You didn't take more than 3 in any one day, and neither you nor your wife are above the possession limit.

Scenario 3:  You get and ab and gift it to a friend how doesn't have a fishing license/ab card and doesn't already have 3 abs in his freezer.   In this case a note with your name, phone number, license number, ab card number, etc...  could be useful, but I don't think it's legally required.  As long as there is no evidence that your friend actually caught the abs himself (wet dive gear, ab iron, float tube, etc.. in his car at the time) there shouldn't be a problem.

One of the exceptions to the "daily limit = same as possession limit" is trout fishing. In many regions, lakes, rivers, etc it is legal to catch+keep 5 trout per day, yet have 10 in possession.
This comes in handy when backpacking/camping because you can keep 5 on Saturday and then keep 5 more on Sunday (and you won't starve to death Monday-Wednesday when the bite turns off and a racoon has eaten all your burgers!).

Duck and goose this the same way.  Where the possession limits is double the daily limit.  I was stopped by a Fish & Game Warden.  Had the note and had no problem.  With my buddy's birds...I was 3 over the the possession limit.
