I've seen this happen in other communities that went from a niche activity to a mainstream thing. The bigger the pool of people gets, the more it is going to resemble society at large. 

Yeah, I found a guy from down south that was using one of the perch pictures Amadeo painted for the Sand Crab Classic.. He was cool and does not use that image anymore. "Just something I found on the internet.." So it was a mater of education. Good guy I hope to surfcast with him this summer.

Die Hard, Adam Irino, I've always thought he was a good guy. I'm more or less on his side from that video where the juvenile commercial fishers were harassing him for fishing "their" spot. Most of the serious fishermen I know around SantaCruz including commercial and charter guys feel the same. But lately, I've heard some serious rumblings as he exposed a couple sacred running freshwater locations. He was confronted in person by a master. Don't think he'll publish THAT video. I might give him a call.  I'd like to believe he's a good guy just coloring outside the lines.

So two kayak fishermen have a concern that one of them is, intentionally, or unintentionally, using the others exclusive artwork.
 So they calmly, like rational men, clarify the situation and decide how to proceed.
I doubt we will be treated to the drama of legal action around this.

Your boss was registering a Trademark, which does indeed require registering in order to defend.

Not really. Yes, TM registration confers major benefits, including presumptive ownership.
But US recognizes common law TM rights that can be enforced against infringers w/o registration.
Just gotta clear more "hurdles," so to speak...
