Generally speaking snagging is legal in the ocean (with species restrictions). Gaffs are listed as a legal method of take, generally speaking. Tuna have no restrictions on methods of take in DFG ocean regs so I would say it would most likely be legal in CA*

Not sure why you're still stuck on that. Like I said a definition is a definition and they're not going to have 2 definitions of "snagging" (ocean/fresh water).

They're zoning in on the term angling (1.05 in the regulations). Look at the regulations and see if that applies to any of the tuna species.

I said I looked at the regulations and couldn't find where it was allowed.  I can't prove a negative by pointing to a section that doesn't exist and say :hey, there it isn't!".  You say it is allowed and point to a section that doesn't apply to ocean waters.  I'm not looking at 1.05, I'm looking at §28.65-  "Except as provided in this article, fin fish may be taken only on hook and line or by hand. "  It doesn't say anything aboutthe fish voluntarily taking it in the mouth, it just says hook and line, so old school pier snagging is fine and legal.  A gaff isn't a hook and line.

You are quoting 2.00, which is the first regulation under the heading :

Chapter 2. Statewide Regulations for Fishing and Frogging in Inland Waters

2.00 doesn't apply to ocean regulations.  The forward to the regs, while not law, says so too.  Chapter 2 does not apply in the Ocean and San Francisco Bay district.

So I'm still on this because I'm right.  Please, please point me to a regulation or statute that says otherwise.

Where is gaff listed as a legal method of take?

I see 28.65 which says:  (d) No gaff hook shall be used to take or assist in landing any fin fish shorter than the minimum size limit. For the purpose of this section a gaff hook is any hook with or without a handle used to assist in landing fish or to take fish in such a manner that the fish does not take the hook voluntarily in its mouth.

The species that you are not allowed to snag, as in with a hook and line old school pier snagging, are salmon, striped bass etc., and those species specific regs all require the fish to be taken by angling as defined in 1.05, i.e., voluntarily taking the hook in the mouth.

As for lingcod, i don't think that gaffing or netting a hitchhiker is legal either, but I do know that everyone does it and I even think Carrie Wilson said it was cool, go for it, and I myself do it because its such a common and accepted practice, but a technical reading of the regs says don't do it.

-Juglines are restricted to no more than five hooks per line and 20 juglines per person.
-Limblines are restricted to no more than two hooks per line and 20 limblines per person.
-Snagging, the dragging of one single hook or one treble hook attached to a fishing line through the water to impale fish, shall be lawful in all waters year-round for nongame fish only unless restricted under “Special Area Regulations.”

I love tuna... or at least catching them.

The next time I'm out, I'll start tossing out chum and if one gets close enough, [I'm gaffing it | grabbing it with my bare hands] and the tape will be rolling. 

Btw, there was a woman in Malibu who caught a BFT in the surf with her bare hands.
