Strangely enough I believe that would actually be a legal method of take in CA.

i guess if you're lucky enough to see one,(while on a dock,pier or shore) the law allows you to kill it anyway possible?  SWEET!

It should be legal as long as he has a license. I'd do the same thing and tried doing that to a finning wsb when I had a revo.

I don't think it's legal. I don't see anything in the regs that allows any type of tuna to be taken from on or above the water any way other than hook and line, bow and arrow, or hand.

Here's what Mary Patyten (DFW) had to say about method of take:

"No snagging is permitted for striped bass, sturgeon, trout or salmon in ocean water."

Gaffing and snagging aren't the same thing.

Of course, the regs as written and the regs as enforced are not the same thing either.

Here's DFW/G's definition of snagging (it's in the FW section, but a definition is just that):
Snagging is defined as impaling or attempting to impale a fish in any part of its body other than the mouth by use of a hook, hooks, gaff, or other mechanical implement. This definition does not include activities otherwise authorized under these regulations for the lawful
use of a gaff, bow and arrow, or spear.

That definition is specifically limited to inland waters tho

Not sure why you're still stuck on that. Like I said a definition is a definition and they're not going to have 2 definitions of "snagging" (ocean/fresh water).

They're zoning in on the term angling (1.05 in the regulations). Look at the regulations and see if that applies to any of the tuna species.
