Man, it's amazing how quickly folks here with throw a fellow kayaker under the bus, so to speak, when the person who's been accused of something wrong is known personally. 

I looked up the US boating right of way rules.  Here's what I found that I think applies to the situation;

Passing a boat

I had a client once that turned out to be a Maritime Law lawyer.  We discussed right-of-way laws and he told me the most important law was unwritten.  They call it "The Law of Gross Tonnage."  In other words if the boat is bigger than yours, you better MOVE.  Ask Polepole about Herring Cove in Ketchikan.  Only time I've sen him pissed enough to call someone out.

As a "working vessel" with fishing gear out, he (The Velvet out of Ketchikan) had the right of way.  But he purposefully aimed his boat at us multiple times, and verbally threatened to run us under.  Dick move for sure.  And yes, we moved.  Shit happens ...

I don't know how many times I have avoided harm because I've been fat, dumb and happy in my ignorance.  Way too many, I'm sure.  This thread has really been a wake(sic) up call to never venture into new waters without someone with the experience behind them to educate me.  (On the ocean anyways) 
Kayaking is risky behavior.  Like my skiing, off road dirt biking and street motorcycle riding.  Now I have to seriously consider as I get older if I'm up to the challenge since I don't kayak fish enough to have the experience.  I've made the call on street riding and sold the bikes.  Got one trail bike left as well.

 Agree 100 percent, I come from both sides as an avid kayaker and boater, but sometimes it's better to be proactive, turn into the wake, peddle or paddle and dangle your legs over the side for more stability. I just hate to try and make this a Boater/kayaker battle when HMB has been soo great to us and there is a lot of ocean to be shared.

That being said, I don't understand how people can blame the kayakers. When you operate a boat you need to stay alert, no matter what. This situation seemed entirely avoidable by just looking around and proceeding when safe and clear. If you can't safely pass the kayakers, you should wait till you can. (Kayakers must get out of the boat lane as safely as possible too) A sub +100 lb kayak powered by a human shouldn't have worry about a +50 ft boat buzzing them just because they are bigger.  This isn't a slough that's 20ft wide with 15 ft tall reeds and tules where you can't see around the corner. This is an open bay, no excuses in my opinion.

I disagree with the rest of this as well.  It's not an open bay, it's a high traffic harbor entrance with boats of all sizes passing through it. Kayaks are the smallest and the laws of gross tonnage apply.  Proceed with caution and common sense.

You're right and I should not have said open bay. It is a smaller entrance and common sense must supersede above all.

I wish this incident never happened. And I hope incidents like this happen less and less frequently as our sport gets more popular, but most important is that nobody was injured, and we all, myself included use this as a learning opportunity to safer navigate the waters.

I still haven’t heard if they were on their way in or out. On the way out the power boats are moving slow and you have enough time to see them coming. Did they expect the charter boat to wait it’s turn while they paddled out? Or were they coming in and the charter boat was moving fast and caught up to them faster than they expected? Either way it’s like using a cross walk on a busy street. You should wait for a safe moment before getting into a traffic lane regardless of who has the right of way.
