Yakuza, that's a nice little salmon you got there!  I can't wait for the weather up here to finally calm down so I can get out and get one myself.  However, you should be careful about incidental catches of salmon...

First of all if you're fishing in the ocean you are required to carry a net 18" in diameter (this would have saved your thumb).  I'm surprised how many kayak anglers don't seem to know this one, yet I don't know anyone who has gotten a ticket for it yet.  There are a variety of folding nets available that don't get in the way.  It's really a small investment that will not only save you from loosing a fish, but also prevent a ticket.

Secondly, you're required to only use barbless hooks for salmon.  Since you were trolling for white sea bass, I'm guessing you were using barbed hooks. Technically, a salmon caught on a barbed hook is supposed to be released.  If you even think there is a minor chance of catching a salmon it's worth it to use barbless hooks just in case.

Thanks updating us regarding the legal requirements involving an 18" net.  I know some anglers who fish with out one, as this law is seldom enforced, similar to the 55MPH speed limit on highways.

BTW,
I noticed a while back when you posted your Baja trip, that you took a scallop from Mexican waters and BBQ'd it with bacon. 
Just an FYI, this is ILLEGAL.  US Citizens are not allowed to take Scallops in Mexico.

My understandning is if you have rockfish and salmon, you shouldn't have barbed hooks onboard at all.   I'm assuming he was completely barbless and used this post to bait us into this discussion.  Lawyers always stirring up s***...   :smt001

I understand the rules as following:

If you catch a salmon on barbless first... then you can rockfish, but only with barbless hooks.

If you catch rockfish first... then you can still fish for salmon, but only with barbless hooks AND less then 180ft deep (or 240 depending on what zone you're in).

If you catch a salmon on a barbed hook at any point, you're supposed to let it go. ;)




And yes, Stuart is 100% correct on mex rules.  No gringos are allowed to take shellfish in Baja.  This includes scallops, lobsters, clams, etc.  At the time, I thought it was weird that bsteves took pictures of it & incriminated himself... but figured there was some good explanation.

And yes, the net rule is a weird one. Rarely enforced but I was informed of this reg by a park ranger the second time ever yakfishing. Fortunately, I had a folding net in my truck so I just brought that one along. But now I prefer to bring along a big salmon-sized net and stick it in one of the rod holders in the tankwell so it acts like a flag to prevent boaters from running me over. However, one of the dudes in your pic has a huge net! I prefer one with a shorter handle.

Sorry about the previous post, I really intend to scold, just inform for next time.  There are so many fishing regs in California that it's easy to miss a few. As Stuart and Fuzz pointed out we all make mistakes.

Stuart, how long have you held that one back for the next time I posted about a reg?  I knew I'd get some heat for this net and hook post, but never thought anyone bring up a two year old mistake.  Anyway, I was aware of the scallop reg shortly after eating it and getting back to the truck where my mexican regs were. I was thinking there might be a size or catch limit only to find out it was big no-no for non-Mexican citizens.  At the time I had no intention of going clamming or other shellfish gathering so I hadn't payed much attention to that bit of the regulations.  As for posting it here later, well I really didn't think about that either.  I guess I better avoid Mexico until the heat clears. Anyone know the statue of limitations on scallop poaching?

Can't speak for Stuart, but personally I never said anything because I thought it was some "Bodega Crew Marine Biology Recon Mission": operation scallop liberation.   :smt005

Everyone makes mistakes, no doubt.  I just thought it was odd that you would post it on NCKA after finding out it was illegal.  Slightly hypocritical, perhaps.  Brain fart, more likely.   :smt003

As for the statute of limitations, I'm headed to baja tomorrow morning - I'll let you know if the wanted posters are still up.

Ahhh, about 2 years :smt003  I just wanted to inform you in the event you head back down to Baja, for a sequel.

And Fuzz, Can you bring me back some scallops?  Just make sure you PURCHASE them and save the receipt and declare them at customs.

A warden told me that you just can't have barbed rigs ON YOUR ROD if you have salmon on board.  I don't think they prohibit having them ON BOARD...  We could use good clarity on this.

I believe this to be the case as well and I've even seen posts on Coastside's Warden McKiver forum stating the same.
