 hypothetical scenario
 Hillary Clinton catches a limit of Rockfish in Santa Cruz on Saturday and emails Monica Lewinsky and Department of Fish and Game via joint email or Gmail that he will be giving Monica her Saturdays catch.
 Monica accepting the gift of Saturday's Rockfish limit and emailing or Gmail Hillary and the department of fish and game simultaneously.
 would Hillary be allowed to fish on Sunday and be in compliance with the law to be in sole possession of both women tattoos

It is not about giving away the catch, it is about possession of the actual fish. So unless she is able to transmit her catch limit over email, then no.

Gifting != possession.

The gift is effective. The fish are now Monica's. Hillary can't fish the next day because they are still in her possession. Monica doesn't pick them up the next day either, and shuts off her phone for a couple days. Hillary can't fish for several days because she is in possession of fish that she has no right to dispose of because they are not hers. In a fit of rage over not getting to go fishing, she throws the fish in the trash. She is cited for waste of game and destruction of private property. She is pardoned by Obama and becomes your next president.

Yes, go ahead and gift them, ship them to the gift recipient via common carrier, and you can fish tomorrow.  You don't need to email CA DFW either.  Depending upon which state you are shipping to you might need to fill out that state' form.  If you are doing it from California to California, you're good to go.

Hillary, Monica, and rockfish? It all smells a little fishy to Bill. 

Keep in mind that the water is muddied some by the fact that we can easily be in sole possession of an over limit if we are home alone with multiple legal possesion limits. It seems that it is illegal to be in sole possession of an over limit everywhere except at home. Then again, maybe it's illegal at home also, just not enforced. If my son and I each bring home a limit and put them in the freezer we are breaking the law anytime there is only one person at home.

I like the email idea though. Gifted and accepted. It should stand up in court, at least with family members. Who wants to test it?

What the hell do you mean however you might interpret that?  A common carrier is a very specific thing.  You have to ship sport caught game by common carrier if you are going to ship it.   And they have their own rules and forms and dfw rules that they have to follow.  You are free to look them up or stop in and ask them.  All this stuff has been thought of before and is dealt with in the regulations or the fish and game code.

why are you worried about the fed ex employee?  do you think he's going to get cited for possession of the shit in the box in the back of the truck?  You think UPS employees are risking prison for cocaine possession every time they hop in the rig?

If it is not handled safely, cal/osha gets involved. If I take the fish as evidence, can I stop and fish on my home? Or will DGS write me up for personal use of state resources?
