So if you bring a rod out spearfishing during the closed seasons for any reason, then you would be in trouble?  What if I wanted to fish for perch after shooting a few perch?  :smt003

Yes, but:  (4) When diving or spearfishing, as authorized in Section 28.90, all species may be taken or possessed
year-round. Except for spearfishing gear, all other types of fishing gear are prohibited to be
aboard the vessel or watercraft (motorized or non-motorized) while spearfishing for the purpose of
taking or possessing these species under this provision


I guess I dont understand this part here:

It basically means you can't spear rockfish (or other species closed to boat-based hook&line fishing) AND have a fishing rod onboard your kayak. Even if you simply wanted to spear rockies and then fish for perch (which ARE open to boat-based hook&line). You'd have to return to shore and ice your rockfish before paddling back out to fish for stupid perch.

Perch aren't closed under that section.  Its talking about RCG + lingcod.  You can shoot a perch and hook and line a perch on the same trip with whatever gear on board you want.  Just worry about RCG + lingcod.

"These species" is referring to the ones that are closed to boat based angling...and since perch is open year round you could have a speargun and a rod and reel and shoot and catch them but could NOT shoot any species that are closed to boat based anglers like RCG/Lings...

FWIW Luis, we (fuzz, Rick and I) would never have set up DOTY in a way that would break (or even give the impression of breaking) any DFW regs....

Which is why the DOTY rules state:

Wow so many responses. It was funny reading how people thought they could work around the law.  But the part that cracks me up is why would you go spear rock fish and then return to get fishing pole so you could kayak somewhere to get perch. 

Just spear the Perch while you are spearing the rockfish.

Wow so many responses. It was funny reading how people thought they could work around the law.  But the part that cracks me up is why would you go spear rock fish and then return to get fishing pole so you could kayak somewhere to get perch

Just spear the Perch while you are spearing the rockfish. 

Because you want AOTY points.

Yes, it is illegal to use a boat/kayak to reach areas that would otherwise be inaccessible--for the purpose of hook & line fishing (for species that are closed to boat-based fishing). Because you're basically utilizing the boat/kayak as a means to harvest said fish via hook & line.
But in the case of spearfishing, it is legal to harvest rockfish (for example) year-round; from shore or boat/kayak.


[side note: it IS legal to physically swim out to such an area and fish hook & line for species that are closed to boat-based fishing]
