It is really a shame. The version I heard (caveat: secondhand informtion is less reliable) is that Pace (who manufactures Megabait lures) decided to grow their product line and introduced an new lure capturing 5% of their revenue that was quite close (jury ruled this) to an existing lure patented by a large tackle firm. Court battles ensued with a win then a loss for Pace--the  result being that Pace now is going out of business due to the legal fees and damages. I wish I could have known and talked to the Pace founder before all this and persuaded him against this campaign ending in the death of his company. It is a poor business decison to 'bet the company' on a lure with 5% revenue share in a legal battle with uncertain outcome. I hear he mortgaged his house--he may lose everything. What a tragedy due to ego and pure ignorant bull-headedness. And I think Megabait lures are very, very cool. Sad.

My persepctive on the legality. If you bought the lure molds that made the copyright-infringing lures and sold them commercially--yes. But if you bought the non-infringing molds for personal and commercial use and even the copyright-inflringing ones for personal use--no. Copyrights only apply if there is financial or other equivalent gain (like donatation to charity, etc.)

was the live jig the problem? they make many lures.

if not, you will see a new company with the lure under a new name.

if so, you may still see the same,  :smt002

I jsut realized I've been syaing 'copyright' while this is instead probably a patent case. I got this all second hand so I really should go find the decision and see for myself. I'll do that and publish what I find out. then again, there is a decision and then there is a settlement conference nad settlement terms that latter of whcih may never be made public.

Yeah I am going on the basis that the lure that caused them problems was only 5% of there revenue and I am guessing the jigs are more than that. So the jigs should be clear of any legal issues. I am hoping they go into bankruptcy so no one loses a house or anything. It all seems rather silly to me as both sides lose in this case. Megabait blows up and the poeple that sues are going to get like nothing if megabait goes belly up. Sounds like a lot of stupidity all around.
