Punishment should match the crime.
I guess the question is what fits.

an ass kicking would be good except what if you are small, and the scumbag is large or armed?

Lots of people feel residential burglary is not a big deal.  Until they are ripped off.  Or like an elderly lady I know who simply didnt answer the door because she was sick in bed.  The guy came in and scared the hell out of her.  Now she is afraid to live alone.  What fits?

Oh believe me; I agree they s/b punished. Impound the boat & fine each person on it! But confiscating a $30K boat is over the top. Just trying to keep it real. And it seemed like we were being a tad unrealistic. Btw I'm totally in favor of capital punishment.
I'm not saying it's less-of-a-crime because it used to be legal. I'm saying that the punishment used to be handled on a personal level. Like a good old asskicking.

Simple, the boat is impounded for 15 days, in an impound yard for first offense. Storage and tow fees must be paid before getting it back. This is the same thing that happens to you in California if you are driving on a suspended license.

the punishment should be that they pull all the traps in the bodega crab ground but leave the crabs alone and leave a cold brew in the trap.   :smt003

Yes a good asskicking would be good but you would be the one in jail plus sued for YOUR BOAT. but the asskicking you gave fit his crime I guess you would be happy that way while your sitting in jail and court.

Art, for the remote possibility of getting caught & a measly $1g fine I believe most of these dickheaded crab burglars will continue to rape your pots 8 days a week. That's twice on Sundays. No boat = no more thieving. Or you could try some 'copper clappers'......

Impound the boat AND tow vehicle for 24 hours.
Throw them in jail for 24 hours with no outside contact whatsoever.
Cancel the insurance policy on both the boat AND vehicle.
Leave them both parked, unlocked, unguarded, interior lights on with the keys in the ignitions in west Oakland overnight.
Let them feel what it's like to 'hope' no one takes their stuff.

Measly $1g.... pretty sure your average joe crab thief would be reeling over pissing away a thousand bucks. I guarantee you 99% of that $&@" stops real quick if the dfg runs a dummy string with marked crab and busts people with them back at the ramp.  Loss of license for a year sounds reasonable also, makes the boat pretty much useless while serving the penalty.  Seen a case in Ohio recently where a woman was sentenced to holding up a sign declaring only idiots drive on the sidewalk to get around a shoolbus (or something to that effect) cause she did just that...... Maybe a sign that says I'm a pos crab thief while standing in front of the harbor.

E2 asked a legit question, what fits the crime?  Legally, sport caught crab have zero value and they're technically not yours until you pull the trap and box them.  It's not a case of someone stealing your car stereo or laptop which have a monetary value.....to use rh's analogy, it's more like you were fishing and went to take a leak and someone reeled in your fish.  I'm not quite ready to throw the constitution in the trash over stolen crab.

If we were gonna go old west on their azz I'd rather just line them up and give everyone who has a crab pot soaking on the coast a free kick in the groin.

1st offense should equal 30 days in jail, no time off for good behavior.  Boat is impounded for same amount of time. $1,000 fine and fishing license revoked for 1 year.

2nd offense you double everything.

3rd offense should be 1 year in jail with no time off for good behavior, boat and tow vehicle is confiscated, $10,000 fine and fishing license is revoked for life.

If fines are not paid during any offense then fish license is revoked for life.
So long and thanks for all the fish!!!
