Got this from the CDFG News release, so if you are gifted an ab be sure the tag is filled out correctly.

Question: If someone gifts abalone that are tagged but the tags are filled out improperly (or not at all), who gets the ticket, the person with the abalone or the original pickers?

Answer: Both individuals can be cited. The individual who took the abalone can receive a citation for failing to tag abalone or improperly tagging abalone. The individual who receives the abalone can be cited for unlawful possession of abalone that are not tagged or improperly tagged. (Fish and Game Code, Section 2002).


This is the one thing that comes to mind to me on this and that is most of the time the person that is reciving the "Gifted"  abalone typically does not dive or know any thing about the regs and laws. Most of the people I have given it to never has had it before ! seams like they should go after the person who picked not that hard to track the tag back to the ab card and get the info from there and send a ticket in the mail.

I don't believe that this is required, but whenever I gift an abalone to someone that will travel with it, I write out a note with the date, my name, phone number and fishing license number along with the name of the individual I have gifted the Ab to.

To my knowledge, it has never been tested, but I think it could help if the recipient is checked/challenged.

During duck season we gift ducks to people we take out.  These are all birds shot on the same day, so there is no way of saying a portion of them were from the previous day.  A warden had told us we could gift up to the possesion limit, but when gifting birds shot the same day; the person with the birds had to have a signed paper with, date, hunting license #, address, phone number, and had to identify which birds were gifted and to whom they were gifted.
