THANK YOU SO VERY MUCH! Relieved by what I heard from a lawyer I spoke to that has experience in this matter,

Quote
Darius, my serious answer is why not contact a lawyer with experience in the matter at hand instead of posting on a fishing website?

this is why I post this here cause I know I will get more help than random lawyer website Thanks BROS who PM'ed you guys are wonderful!!!!

I was going to say hide the evidence but that would probably hurt a bit. If you cant afford the time, dont do the crime is a motto to live by.

Whatever you do, I wouldn't say anything more about it to anyone (especially on a public website).  Let your lawyers do the talking, because that is what you pay them for :)

I hope it all works out.

Kick someone's ass the first day.  Either that or become someone's bitch.

That is funny $hit right there!
Live your life, the way you want to be remembered. Don't have any regrets, we only get this one dance to make it count. Start at your eulogy, and work backwards.

IANAL, but some things stand out for me:

1) You said you received a summons in the mail. Was this Certified mail? If not then this sounds VERY SUSPECT.

2) What are the Docket # and Court date? If none, then again, this is very suspicious

3) Does the summons mention downloading? Copyright infringement? File sharing? All of the above?

Do keep in mind, that downloading does not violate copyright. Providing content does.

I HIGHLY recommend you read the EFF page on file sharing defense:

You would think that personal service or substitute service would be required in such a case in California.  I don't know federal guidelines  though.

Gawd am I glad I am no longer process serving.
