S.F. tax scofflaw sentenced for poaching trout

(05-27) 16:54 PDT GILROY -- A San Francisco businessman has been sentenced to 15 months in federal prison for violating the Endangered Species Act by poaching steelhead trout, a term he will serve while also doing time for income tax violations.

U.S. District Judge Maxine Chesney imposed the sentence Wednesday on Luke Brugnara, who pleaded guilty in January to illegally capturing a threatened species and making false statements to federal investigators.

Prosecutors said Brugnara, 46, admitted poaching steelhead by building a dam in 2007 on property he owned in Gilroy, preventing the fish from migrating upstream.

On Monday, another federal judge sentenced Brugnara to 2 1/2 years in prison and ordered him to pay $1.9 million in back taxes for failing to report profits from real estate sales to the Internal Revenue Service from 2000 through 2002.

Chesney gave him a concurrent sentence in the steelhead case, allowing him to serve both terms at the same time.

This case has been going on forever, so I'm glad they finally nailed the guy. The property was on Little Aurthur Ck, a tributary to Uvas Ck which flows into the mighty Pajaro River. It's right along 152W towards Hecker Pass. He built a dam on the creek that impeded steelhead passage and was asked to remove it many times. Then was caught fishing for & taking the adult steelhead that were holed-up in there (there's no fishing allowed in this creek and those steelhead are really rare).

Was there a fine it not they just let him off free since he is already doing time. They should take the property.
