Martin,
Here's my dumb answer  :smt003
There's no law against shooting fish you can't identify, nor is there a law against keeping a fish (hook and line) you can't identify.

But an angler (both spearing and hook and line) is responsible for knowing the current laws and regs.
The current DFG reg's specifically state that certain species of fish are illegal to spear, although legal to catch (striped bass happens to fall in this category) and a responsible spearo would know this.

To tag onto this if you shoot a fish which is not legal to shoot you could also recieve a ticket for waist of resources I think because you killed it for no reason.

Dude! You freedive Marina beach? Ballsy considering the recent GWS attack there. Not to mention the conditions can be downright treacherous. But I'm guessing you were looking for a challenge...heck, anybody can spear flatties about 4 miles south of there.  :smt002

Well said Stuart, and I too wish we could shoot them. Ocean only though.
