The difference between (a) jetski engaging only jet drive and (b) jet ski relying upon a trolling motor does not appear to turn on the position of the operator (the "on, astride or behind" part of the definition).

The jet drive versus trolling motor seems like its more relevant to the "propelled by machinery" clause.  Even still, I do not see how a trolling motor is not "machinery" whereas a jet drive assembly is "machinery."

In both trolling motor and jet drive, the movement of water for craft propulsion is actuated by a machine.

And whatever the ski is propelled by, the operator still sits atop it?

How does this fall outside of the definition at part 922?  Like a ski, this is:
  • any vessel
  • propelled by machinery,
  • that is designed to be operated by standing, sitting, or kneeling on, astride, or behind the vessel

Just like any machine-driven kayak would ...
Maybe the distinction lies within one of the exemptions

Im interested to learn more about fishing from a PWC.  Seems like Seadoo hav the Angler series w entry model fully kitted out for anything that i might try in a yak.

Downsides is its a regulated vessel that needs a tow, cant portage, need boat launch.

Another downside that I just found out about today is that there are a bunch of PWC restrictions in the SF Bay from the late 90’s when a lot of jet skis were two strokes.   I’m not 100% sure, but it appears that a lot of the water in Marin County forbids jet skis, and you’re not allowed to ride within 1,200 yards from shore around San Francisco, Alcatraz, and Angel Island.   It’s an old law, so I’m not sure about the enforcement these days.  And, I’m not sure if they treat chill jet ski fishermen drifting for halibut or stripers the same as they would normal jet ski guys who are just running their motors full throttle and annoying everyone.

Similar issues out of HMB and Monterey Bay, too:




That applies to the entire Monterey Bay National Marine Sanctuary which runs from 7 miles north of the Golden Gate Bridge all the way down to Cambria and out to 30 NM off shore.

OK.  That is such the bummer.  I need to do some more research.   That totally kills it if I’m not allowed to go outside the operating zones.

I wanted to keep my last post to pure facts... but I'll opine here.  I have never even heard of this being enforced outside another boater reporting one of the more splashy/speedy type of PWC operators.  In my years as LEO on the water, I never once heard of targeted operations towards PWC use.  The purpose of the PWC ban is to protect habitat in the sanctuary.  I seriously doubt you'll have a problem with enforcement.  That said, it only takes one officer who has a hair on their ass for PWC fisherpeople to ruin your year.  The first fine is reduced, but then they start to ramp up for "repeat offenders."  Just wanted to clear up the spirit versus letter parts from my experiences so it didn't seem alarmist.

I have seen this enforced multiple times on the Monterey Side. I took out some jet skiis but went to the correct zone and when I returned a NOAA officer was waiting for us. He thanked us for following the rules and mentioned multiple people called on us as we were out there. The NOAA officer watched us from binoculars the entire time. I have also seen it enforced at half moon bay

Of course, they did.  With that long of a lead time, shoot, they'd be nuts not to ...

On the real though, i think this reg (and especially the PWC definition) has bigger holes than a salmon net, seems over-inclusive and not narrowly tailored to only affect PWC's, and therefor subject to challenge.

If you guys will go-fund my bail and get tedski to be my expert defense witness, I'm game to take a ski out on some SWLT rcg run to test the waters so to speak  :smt002

The only jetski's I have seen launch or land at Santa Cruz are lifeguards and/or military (on trainings).  Harbor Patrol will stop them at the launch ramp if they see....

Skiffs are cool.  But then, I have a 72 GMC 3/4 ton pickup that has not been washed in seven years, whereas the see doo guy probably drives a Subaru coupe with those loud tailpipes and the black windows yeah?
