Here is what I've found:

Under CCR Title 14, section 28.95 if you were not in the water but in a kayak, boat or on the shoreline, it can only be used to take skates, rays and sharks (except white sharks).

Do you have to net or gaff a white shark then?

Try a salmon net.

I see too many of these questions that are contenders for the Darwin Awards. 

Seriously, if you just take a minute to think about your question, it shouldn't matter if its legal or not, just sounds like a BAD idea!  Out of the numerous methods of take easier than a speargun, you chose that one.   :smt012

If it's hitching on another lingcod and you're fishing where the limit is one then I'd say no.

Also, having a loaded speargun handy outside of the water while fighting a fish on rod and reel sounds like a disaster waiting to happen.

Try a salmon net.

So, since the limit is now 1 Ling, technically speaking, you’d have to keep the smaller one with the hook in its mouth, right?

Lets say that a massive ling decides to hitchhike on one of my lighter weight setups.  Would it be legal to use a speargun instead.  While it may not be as sporting, it would seem to be less risky for a noobie who doesn't want to risk going for a swim.
YOU'RE GOING TO SHOOT YOUR EYE OUT WITH THAT THING  :smt011 Or at least your foot. Please don't (sounds like something I would try) too much could go wrong over a fish.

I personally know someone that took a spear to the head. He then had to climb his way out of the cove up a cliff with a spear sticking out of his head.  It wasnt pretty, but he made it.
