I believe abalone follows Same rules and regs. on a two-day trip to the ocean you can gift your wife a limit of abalone and dive the next day for second limit and it would be perfectly legal for you to be in possession of two limits. providing your wife is with you.

There's nothing wrong or illegal with that. Recipients of gifts of game do not need licenses. If you're mojo and fishing in Oregon you need to fill out a form, but other than that it's the same there too.

I don't think I could live down there , hell when I come down on vacation I might have to bring both my big tuna seats so my attorney can ride with me to verify the legality of the jig design, weight, material consistency as well as plastic bait chemical components and levels ,color, length, proper insertion if aforementioned jig.. Breath... And then once I get  a hookup make sure proper jig to lip angle is correct, Rod length if bringing the fish in, as well as to let me know if I have the right to net, lip grip, or gaff said catch, and if I need to read the fish its Miranda rights before I smack it's littl cranium with a fish bat of proper size , shape, material, and the exact force one can or cannot apply to a fish skull in California......... Deep breath...... Then make sure it's ok to cut said fishes gills and place it on a stringer in or out of the boat/water/cooler/burlap sack/ pants. How long and WTF  color of Rod can I legally use in the ocean there and please let me know the reel and line regs.  :smt013   :smt008

Adding additional language into the regulations to clarify every possible scenario can become overly complicated and self defeating.  98% of people already don't read them anyway.

Much of my day job is about writing/editing/updating specifications and regulations.  Not related to to anything for government agencies, but the general rule in all of the organizations I work with is that anybody is free to criticize anything.  But, only if they can provide specific alternative language or changes that solve the identified problem and don't break anything or create even bigger problems.

Does anybody have a specific proposal or suggestion?

Reorganizing the regulations. Making them easier to navigate and read. I have several technical changes and about a dozen substantive changes that I believe need to be made.  But I think reorganization should be the first priority.

No, I  have not drafted a proposed reorganized regs book.  That's a tall order.

I generally agree with you that problems should only be presented along with a solution, and I am willing to assist I'm the drafting of a reorganized regulations book.

But as for the stuff in this thread it ain't broke.

Fair enough.  I don't find the particular reg sections mentioned to be "broken" either.  It's certainly useful to try to apply specific scenarios to general rules.

And, there's a cathartic value to complaining, whether general or specific.  But, it's easy to just be a critic.  So, I'll always appreciate the people willing to implement change or at least make a proposal.

I don't know if broken is the word I would choose. However I do nave a problem with the reg.

If I am camping with my wife near the coast with two cars. We take one to the coast and fish for the day. Head back to camp and I gift my fish to her. We go back the next day and I catch more fish and keep them for myself and head back to camp. We spend the night and we are completely legal. As it turns out she has to go to work and I am going home which is why we brought two cars. So does a completely legal scenario become illegal when I drive home and she heads to work? I don't think it is the intent of the law to require the "owner" to be with the catch at all times. I'd have to check the regs. Does it mention special conditions when transporting the catch compared to when it is at home in the freezer? I assume it's legal to be home alone with a limit for each of my family members in the freezer. I also want to assume it's legal everywhere else also unless specifically prohibited in the regs.

In the case of the CA regs, the complaining is completely justified in a whole lot of instances.  There are regulations that are not enforced as written.  There are regulations that make no sense.  THere are regulations that use different words to mean the same thing as a different regulation when they should be using the same word to mean the same thing. 

Traildad's complaining has actually had a positive real world effect on new language in the regs dealing with Petaluma River Sonoma Creek and the Napa River.  He has the ear of someone that can get things done.

Yes, the intent of the law is to make that scenario illegal.  I'm serious.  Think of fish as cocaine.  Or medical marijuana or whatever.  SOmething that is highly regulated and that can get you into trouble if you get lazy with complying with regulations.

Ken and his wife are camping at Van Damme for three days. If Ken's wife is pregnant and due any day, can they have three limit of abalone over three days? Even tho his wife is still in possession of the baby, can he gift them to him/her?
