In fisheries with number limits (e.g. bass with a five-fish limit), the limit is defined by a number of fish. “Take” is defined as the hunt, pursuit, catch, capture or killing of a fish or the attempt to hunt, pursue, catch, capture or kill a fish. If the limit is five fish, and you have five and continue to fish, you are attempting to take more than five, which by law is considered “take” of an overlimit. It’s a subtle difference, but it is different. By allowing “zero take” fisheries, the Department of Fish and Game (DFG) is allowing angler opportunities where fishing may occur without the retention of any fish.

1st of all, not right to upgrade and release a fish kept on a stringer.

But so your saying with the above quote all bass tournament anglers partake in the illegal activities of upgrading for tournaments?

Also, If you have a limit of lets say LINGS or Cabbies and continue fishing for rockfish then your partaking in illegal activities. Or say limit of Salmon and then fish for rockfish even with barbless hooks then it would be illegal.

So please find the actual rule to that somewhere if your gonna bash someone else and tell them they are doing things illegal. The DFW Q&A is cool but that does not stand in court, not for a second unless it comes strait from the bible of ever changing California Regulations and Mandates.

Yeah that.

Also, hi grading, besides waste of a fish, puts you over the possession limit. Once you have reduced a fish to possession in your daily limit, you can't unpossess it. Eat it, give it away, or wantonly waste it, it's still part of your daily bag limit.

You can incidentally catch a species while fishing for something else, release it immediately, and not run afoul of the law.

Nothing to do with regs, I personally only keep a fish if I'm going to kill it. If I want to hunt a big fish, I'll keep two lings and catch and release the third until I get one I want. sometimes I don't sometimes I do but I feel better about it that way.

If you have one or two and trade one of those out maybe. If you have three on and trade, that would be illegal for sure. You are in possession of and controlling four until you release the fourth one.

Stop guessing at the question....it's either legal or not
I was invited to chime in and I did. As with so many things in the code it can be difficult to interpret. If it is written in a clear manner I'm sure someone will post it up. I am sure that controlling a 4th one while you have three on a stringer would be illegal. I tend to side with crash, if you put it on your stringer, then it will count towards your daily limit no matter what you do with it later.

What if it dies from deep throating ( :smt044) and you cant return but one on the stringer is still alive and kicking then what would you do toss the one bleeding out and probably going to die or the one that appears fine.

if I decide I have too many fish at least I have the option to throw em back alive.

Saying this is Illegal, Does it say this is illegal and that once in possession cant be changed.

I do not worry about sharks, but sea lions are a different story.  Hence, I never float my fish off the boat.  If a sea lion grabs your fish (and they WILL), they won't let go.  Releasing the clip may not be an option if the keeper line is under stress from a 500-pound beast on the other end.  Boat can flip.

Sea lion make me nervous. Also, I carry a knife on the front of my pfd in case I need to cut loose of something quickly (I've had to use it before).
