Found out this little tidbit today from Fish and Game. They do not keep track of infractions, they don't have a data base at this time. They only keep track of misdemeanors and felonies. Now the counties do keep track of citations but I don't think Marin knows what has taken place in Sonoma etc. In other words no state wide data base for Fish and Game infractions.  The gal I spoke to suggested I contact the warden directly or his supervisor and just get them to reissue the ticket to the guilty party. Sounds like a better fix than trying to do it in court.

Its true that a citing officer can issue a notice of correction for an infraction, that will supersede an original ticket.

I dont know if the citing warden will issue a "corrected" ticket just on your word, or even for a case of mistaken ID.

If LEO could simply rely upon defendant's word that he in fact wasn't the person that was cited, but it was some other shmuck that deserved the ticket, my brother would have inherited my shitty teenage driving record, buh lee dat!!

yeah and maybe if the supervisor learns the warden "didn't want to take the time" to issue to correct person, that supervisor might just void the ticket "in the iterest of justice."

I'm still not clear on how he got the citation.  What's the actual precedence here?  Do wardens just get to give tickets to whoever is most convenient at the time? Why wouldn't they simply ask who's line that was?  Can a warden please chime in here?  Was proper DFW protocol followed?  Common sense inclines me to think not.

I was able to talk to the warden that issued me the ticket, which turned bazaar in itself. It seems DFG gave me his private number. I believed it was his business number at the time I called him. At one point he stated that because of the new ruling that one can fish for all onboard a boat. (all being anyone with a valid fishing license) any or all can be cited. I wonder if that means you can take your three year old who doesn't need a license to fish and fish for him or her as well?  The warden went on to say that he tries to get the citation to the guilty party. And he said at one point that I had told him it was my line. That never happened.  When I pointed out to him that that the guy I was fishing with raised his had and said "I ll take the ticket" the warden said he would have issued him the ticket even if he were half done issuing it to me.  The guy i was fishing with did exactly that. At that point our phone conversation became too confrontational so the warden and I decided to let the judge deal with it. The trial date is july 7.

So from what he told me there is no way I can be found innocent even if the judge believes me that it was not my line and I had no knowledge of it having a barbed lure. My only hope is it offends the judges basic sense fairness.

If he's referring to boat limits, the rule isn't new........and he's crazy trying to apply it here.  In salmon fishing, each angler can only fish with one rod, you should only be responsible for the one rod you are using, not all on the boat (especially if there's another body on the boat).

I'd go to court, as a defense the warden gave the wrong person the ticket. And when your friend offered to take the ticket. At that point the warden should have changed it. What the warden did was lazy. He didn't want the extra paper work to change the ticket. The warden, I think assumed you would split the ticket. Or the proper person would pay, as he offered to take the ticket late in the game. To me if I was sitting in a jury box I'd let you off. Because the warden didn't do his do diligence in his job. All you have to do is ask the warden if he saw you use that rod.

I had to go to court with my son twice from trumped up DFG citations.  Both times when my son explained the details to the judge, common sense prevailed.  The second BS citation issued by the same DFG punk, with help from his A HOLE reserve Sherrif buddy pissed the judge off. He dressed both of them down in court.  Go to court and I hope you get a judge who listens to common sense.

Mired in a rattlesnake pit of liers.  I lost my case. It was close and the judge wavered but in the end he stated based on the DFG agents testimony I find you guilty.

The warden came into court and denied my fishing buddy reeled in the line in violation.  He did reel in that line.
When presented with an accurate digram of where all the parties at the scene were he said that he didn't think was accurate. It was completely accurate and shows me piloting the boat and thus not reeling in the line in violation.
When presented with the fact that the fishing buddy had held up his hand and said "Ill take the ticket" said it never happened.


It is very very sad when agents of our government are willing to come into court and make things up. How do men live so devoid of honor? I feel far more sad for my neighbor and the warden than angry. I lost some money buy they have given away something far more valuable.
