CESA prohibits the take of listed or candidate species, even if that take is incidental to otherwise lawful activity, unless authorized by permit. As defined in state law, take means “hunt, pursue, catch, capture, or kill or attempt to hunt, pursue, catch, capture, or kill.” Anyone who takes a white shark without a permit may be cited for violations of CESA and subject to criminal prosecution.

They have tigers, thresher, halibut. So if this might be the first recorded GW from the beach in Ca. How could you say he was targeting GW's specifically? Now the continued filming and displaying of the shark for video is of concern.

There's no way to prove he intentionally targeted GWS.  It's known that juvenile GWS feed in the shallow warm waters of the SD coastal waters.  The LJ and Scripps canyons attract all sorts of large predators.  There are huge 7 gills, threshers, makos, and even hammerheads that are just off the kelp beds there.  But if he were to target these "legal" species, he'd have a better chance from his kayak.  From what I've read about the juvenile GWS, they are very shallow.  More than a few times I've heard of surfers and people playing on the beach about seeing baby GWS swimming by.

Keep in mind that this style of fishing is something he did a lot of in the Gulf of Mexico where he is from.  It's what he is used to doing, so it shouldn't be too surprising that he was utilizing this technique.

We did a lot of that style f fishing in Florida as well .... for sharks.
