Hello My NCKA's. Looks like Team Something will be down to just me, Novato Dave. JWR will be visiting the family in Cape Cod and T-Dub got a last minute invite to fly fish Alaska.

I thought I might bring the following to the attention of the group.  DFG/DFW has a couple rules having the potential of tripping some of us up.  28.90(a) states" no person may use or possess a spear within 100 yards of the mouth of any stream in any ocean."    So, could we be at fault for merely having a pole spear or spear gun in the campground and more so as we egress the river into the ocean?  Does the term "spear" include pole spear and/or spear gun?    How many kayak anglers employ the use of a gaff to assist in landing a fish?  DFW addresses that as well...  see 2.09 in freshwater regs forbidding gaffs within "100 yards of any canal, river, stream, lake, or reservoir".  I telephoned Redding office of DFW earlier in the week seeking to speak to a game warden regarding clarification of 28.90(a).  Phone call has not been returned.   Thoughts??

I've been checked by DFG multiple times at the river launch right there at albion. With speared fish and spearguns on yak. None of them has ever said anything about it.

I wouldn't worry about that too much. They had the world freediving championships there last year and it was a non issue as far as I know.

Hi fishy,
I will respond to your first inquiry regarding spearguns/pole spears.  As Craig mentioned, the 2012 US National Spearfishing Championship was held at Albion last year and there were no issues having spearguns / pole spears in the campground.  My understanding is since the spearguns were stowed and transiting within 100 yards of the Albion River mouth - they were not in use - there is no violation. This may relate to gaffs as well.  If you learn anything different, please let us all know!
