The thing about obtaining a commercial license is if you are not asking all the correct questions that you know you will be dealing with, you may not be compliant with what you are actually doing. I am not sure about kayak commercial but as far as a boat, you need a transport licence for any fish moved from a boat. I would also imagine fish would need to be held to a certain temperature if being sold. I am sure most of these folks looking to make a quick buck either do not know of these regs or just choose not to abide by them.

I had a commercial license in HI some years ago for kayak fishing.

Pros:
I could sell my fish at the auction (kinda neat the first few times you do it)

Cons:
Monthly reporting, even if I didn't catch anything
It felt like work, rather than fun.

I only did it for a year. In the end, it made kayak fishing feel like work, which wasn't great.
