Hi,

I have wanted to do this but have not actually done it, because I am not 100% sure on all the technicalities.

I have been told the process for this is go ab diving first, when done, put abs and gear into car, then bring tank and spear down to shore.  Does this work?  Has anyone actually done this?  If I'm checked at my car at the end of the day with abs and tank in my car, is there gonna be any problem?  Thanks.

I did that many years ago, with a witness  :smt006. In today's climate I would not want to take a chance, and I live 4 hrs from the coast :smt011 If you do go for it, I would make sure of a witness, and be willing to go to court on it.

Technically it's legal, I think, but I sure wouldn't risk it.

The actual 2011 regulation for Gear restriction-

(e) Special Gear Provisions: The use of SCUBA gear or surface-supplied air to take abalone is
prohibited. Abalone may not be taken or possessed aboard any boat, vessel, or floating device
in the water containing SCUBA or surface-supplied air.

SCUBA in a vehicle with abalone could end up being a huge PITA especially if you run into a warden with something to prove. Imagine if they confront you right when you get back to your car with all your equipment wet, it would end up in a pissing match. Like others have said... not worth the risk, free dive while spearfishing and you can have both.

If you do it that way, you "should" be fine.

It follows the main legal criteria.

Thank you for your adivces.  Maybe I'll take a trip just for spearfishing.
