nearshore weather buoys

I know it illegal to tether or more to a weather buoy. jingle bells or fort ross and I don't think either of them relaying data or even functional for the last 2 years. would it not be safe to assume tha hazardt they are Mariners hazard and cleaned up if our tax dollars can keep them providing reliable data
