I like the disclaimer at the end of the article ... "This man was likely violating California’s Ocean Sport Fishing Regulations. Although difficult to decipher for sure, it appears the combination of three regulations in particular provide a conclusion that this is not allowed."

you're not allowed to spear a fish (except sharks and rays) unless you are floating on or in the water.  shooting a fish while standing on a dock doesn't count, just like you can't spear a fish while sitting on top of a boat.

Is it clear in the video who shot it? Maybe the guy that is taking off the fins shot it while he was in the water and handed the gun to the guy on the dock?
