I did have a biologist that couldn't tell a gopher from a copper and another that liked to ask law enforcement questions.

Now that is pretty horrible.

I enforce CCR Title 8, and there is no way I could know all the regs. DFG same thing.Take Title 14 they enforce, add in PC, VC, and other laws they enforce, there is a chance they can over look something or make a false assumption about how a reg applies to a given situation.

But we live in all of them. All of these agencies with overlapping regulation and even the enforcing officers who are responsible enough to learn the regs are left to interpret a percentage of them as they see fit.

That is a huge problem. Even in my office, several of us adamantly disagree about many regs, and enforce them different. How is an employer supposed to comply, when we cant agree in the office?

That's pretty much what I wrote in one part lol...

I drove all the way to Silverado Trails to get a clear cut answer and came back without it. No one could agree, and I was left with "we don't really care." That's not really an answer, you may not, but what about the warden that comes over and does care and fine me....

I asked a warden about foot access to certain turkey hunting area and he said something like"I think you would be fine.  I wouldn't fine you for it" thereby implying that a different warden may fine me for it so I guess we just avoid the gray areas.

Then the ethical thing to do is give the citizen the truth: you aren't sure, then don't cite him!!!  You get someone higher up to advise.  You show up in court with that person and you tell that judge the law is unclear but you wrote him up anyway.  By,, you do issue a citation based on a rule that can and does get interpreted by every authority you personally ally know.  There is a world full of lawbreakers who are without doubt in violation, so why even cite the regular Joe who, like your coworkers, read the law in a different perspective.

Or use some common sense and discern the good guys from the bad guys. Inform the good guys so they know and understand the rules and they will not break them. The bad guys should get crushed.

Building inspectors are the worst. You could call 10 different county/city inspectors out to inspect the same job and you would get 10 completely different results

I dont cite the regs I dont understand, but I always explain what and why I issued a ticket, especially when they run 18 grand for a serious violation with a realistic possibility of causing serious injury. I have guys in my office that work harder to NOT cite, thinking being a good guy will get behavior to change, and it wont. People only change behavior because they have to, in my work, and outdoorsmen, it is through monetary penalties. An ab poacher is not going to quit because someone in green pants tells them to think of the future generations, the same way people arent going to quit cutting det cord with a hatchet by telling them it can detonate.
