You are confused.

The "rag" you refer to, Kayak Angler Magazine, used MY photo of Sean and his son on the splash page of this issue's centerpiece feature. I'm very proud of that full page shot - it highlights a terrific father-son moment and captures a range of great emotions that highlight why we live our lives as we do. It has special meaning to me too. That's Chef's beach, and we'd been out celebrating our friend's spirit the day prior to laying him to rest not far offshore.

The photo is so strong, it propelled Sean to the prime spot in a gear story focused on guide interviews. Sean's business is prominently mentioned in the first paragraph.

An advertiser apparently used one of Sean's photos without his permission in an earlier issue. That's a different situation altogether. His beef is with that business, not the magazine. In fact, Sean called me to thank me for the coverage - no, not for its business utility. For the photo, which is only so good because the character of its subjects - Sean and Chris - shines through. BTW, did you catch the logo on Sean's hat?

Please be more attentive to details before blasting a publication that's been extremely kind to NCKA.

My mom was there when I opened to that page, and I pointed and said "THIS is what it's all about!!!"

I hope it is and it is certainly not ethical to use an image if you are unsure of the copyright status and ownership. But it might depend on precedent for non-explicitly copyrighted works as I believe things published here are.

Bill, is there an obvious warning on the NCKA site that the rights to all photos on the site are reserved by their respective owners and are displayed on the site with the owners permission (via the sign up process--perhaps). Just wondering if that might not provide more strict protection--or maybe you have that already and I am just not seeing it.

In deed they generally are (the details of the exceptions and rules are for lawyer to delve into) which is why I am asking about the site.
To ensure you have rights, you have to explicitly post "(c) copyright <your entity name> <year>. All rights reserved." upon publishing.
even then, although you have the right reserved you still need to bring a civil suit (or raise the credible threat of one) to have the violator cease and desist or even pay monetary damages. Most of us amateurs would find it expensive for no gain whatsoever. At least Sean has a commercial interest involved--and that makes things more interesting and damages possible. Still you have to show harm and the violator might simply terminate the violating use and that would be it. Might be best to just ask them to fess up and remove it rather than start the meter running with lawyers.
