I enjoy Adam's Die Hard Fishing videos but his graphic designer stole my Cabezon design (tracing it as line work) and incorporated it into one of his stickers for sale. I emailed him to remove it from his merch. He seems like a nice guy, so I'm assuming he'll do the right thing... It's not about the money, for me at least.

That's not true.
"You have a copyright in your artwork as soon as it has been created and fixed in a tangible object. It does not need to be registered with the copyright office or have a copyright notice attached to receive copyright protection. A copyright lasts for the life of the artist, plus 70 years after the artist's death."

So don't steal other's artwork or ideas, unless you are going to substantially modify them. Tracing over line work is not substantially modifying.

Not doubting you , we had a vendor “copy” wink our logo at a former employer, this what I remember from the fallout . My employer sent a cease and desist (?) and that scared them off ..hope he pulls it ..good luck

It not fair game. It’s stolen intellectual property. It’s a good idea to register your copyright but it isn’t required to retain the rights to your IP.

Isn’t this the same YouTuber guy that was being bitched at over spot burning and some fairly minor regulation violations?

Your employer is right though in that, fora whole host of reasons including g making an infringement case attractive to an attorney, you should consider registration.

It's all good... just a mixup in terminology.  Your boss was registering a Trademark, which does indeed require registering in order to defend.

Whether or not it's technically fair game, knowingly copying (stealing) someone else's creative work is pretty low.

I saw this post circulating on Facebook, didn't realize it was a member here.

Most already know what I think about spot burner Nick and the boyz.  Dude is straight trash, even if he takes it down, he knows where he stole that artwork from.  The only thing he's sorry about is that he got caught.

Hope it all works out and he ceases to make money off other people's work.
