I am not worried about it.  I covered my ass.

I needed to let you know that unless I have JTF's WRITTEN permission to use his likeness, number seven needs to be omitted from the voting process.   If you want to use it, you may do so at your own risk. Since Marmite altered it to create the blue effect, I can not alter the image so it doesn't resemble JTF.

In ChuckE's post he said to let him know if  a design needed to be pulled out of the voting selection, which is exactly what I did.

I traced the photo of JTF so I have seen a rod bend like that before. Obviously I screwed up drawing the line, but at least give me some credit for offering to help out designing the NORCAL logo.

Good grief!  The reason i didn't sign the permission slip is because I dont have ink in my printer, plus, i've been working like a dog.  I could care less about my likeness being  used. 

I stated earlier that I just didn't want my face used.  Thats it.  Why must we beat a dead horse?  I broke up with a girl for that before, she was always yakkin constantly about stuff that was so yesterday or last year that it drove me crazy!!!!

Mooch - JTF obviously was uncomfortable about using his likeness in the designs I created for NORCAL, otherwise he would have been alright signing the written permission form that I sent to him a couple of weeks ago, (which I also sent to Bill at the same time) which stated that it was okay.

So unless I have written permission from JTF to use his likeness, number seven can not be used. I am not willing to put myself, nor Bill, in that position.

I must say first off it is a major error in reasoning to say "JTF obviously was uncomfortable". Only if he actually posted "hey I am uncomfortable with that" could you actually say he was obviously uncomfortable otherwise you are just assuming and I am sure you are aware of the saying about assume.

Beyond that you mention your own 20 years of experience in the advertising business and yet you felt it was fine to use the image of JTF without his permission and only tried to obtain his permission after the fact when you by your own words should have known better. WTF?

Also it sounds like you are trying to hide behind Bill by "not being willing to put Bill in that position", because you already put yourself in that position when you used the image of JTF knowing what the purpose of that image would be and now it seems you are trying to hide behind the "noble cause" of protecting Bill. Or are you just upset that Marimite adjusted your logo and people liked it better, so you are "stamping your foot"?

Or was this a clever way for you to add to your portfolio and that is why the legal issue suddenly? It would look pretty good to be the designer of the logo for an up and coming group like NCKA but you couldn't really advertise that without all the proper legal paperwork could you?

Unless you are not even following this thread anymore, more than once you have been told JTF is not going to have a problem. So from what I have read you Skygreen are the only one with a problem here, and unfortunately it is a problem of your own creation. You stepped up and wanted to help make a logo, you ran with telling everyone what they needed to do, you designed a logo without permissions and now you scream lawsuit! And the part I don't get is you keep referring to JTF as needing to sign a permission slip but as I understand it he is in a public place which changes things to some degree but (and this part really is bothering me) you never once mentioned needing to get permission from the person who actually took the picture and they are the most important if you want to scream lawsuit. Now perhaps you have obtained permission from the photographer and I am not aware of that but as you have made no mention I still have to wonder. Because Sky you must realize that I or you or anyone else could take a picture of anyone famous or not doing anything in "public" and not need their permission to use the image, but a magazine that wanted to use the image would in fact need the photographers permission not the subjects permission. I believe the job title we would all be familiar with is referred to as "paparazzi".

Please explain what your game is here because at this point that is all it sounds like to me. I have been trying to give you the benefit of the doubt here in my mind but now from your own posts there are things that simply do not ring true to me anymore.

Something else to consider: Is the artist required to give all rights for the winning logo to NCKA, or does the artist retain rights as to how the selected image is used, altered, etc.? It's not only the subject who can become suit happy but the artist himself/herself, if you get my drift. Danger, danger, Will Robinson!

Also, it's not the bend in the rod that is unnatural, it's the bend in the line.

I have to ask... what is your purpose for particpating in this community?  Is it to sell your guide books?  Is it to simply pass the time with conversation?  Is it to achieve a sense of inclusion?   Something else?

This is a Northern California Kayak Fishing message board... you have a kayak, but you live in southern california, you rarely paddle in the ocean, you barely fish (I've never seen a fishing report from you), nor do you seem very interested in fishing, and to my knowledge you've never personally met anyone from this community.  You often chop information from other websites to post on this forum to create an illusion that you know what you're talking about, even when it regarding situations with which you have little or no experience (e.g. the san clemente island post for one).

You seem to have some very thorough guide books for paddling destinations in CA and seem to be pretty good at marketing.  But you seem to repeatedly generate conflict and seem good at coming off as naive when it suits your situation.

If you think the profile I've described automatically makes you "tight" with this group, you better think again.  If you really were tight with this group, you'd realize that all this talk about law suits is hogwash.   I think it's safe to say that many or most are suspect of you and your motivations / intentions.  The only one I'm concerned about bringing down a law suit is you... since you seem so fixated on the idea.

Everyone builds their reputation on this board through their collective experiences and the information they share, and the interactions they have.   So far, you have what I would call a "ten foot pole" reputation... meaning you haven't actually come within ten feet of anyone on this board, and I believe there are many that wouldn't want to come within ten feet of you.
