Final Logo Vote, Get it Done!!!

While that sort of outburst is out of character, the situation warrants the response. No apologies will be forthcoming.  If it needs to be deleted, so be it, but I know I am not the only person feeling this way.

Unfortunately you can not use option #7 as one of your choices.  It is taken from a design I did of JTP using his image which I do not have his written permission to use, nor does Marimate have my permission to use.

As a result Bill could get sued if he uses it for Tee Shirts, banners, stickers, or on his web.

Developing new logo designs for NCKA is a voluntary community effort in this public forum.  If anyone expects to get paid on a design or idea they submitted, then LET US KNOW NOW so we can pull your design out of the voting selection.  And if you say nothing before the votes are in, then you, by default, give us permission to use any designs and images submitted... and waive all rights to any lawsuit against NCkA or its members!

Sky... I hope you understand that we don't operate NCKA to make a profit.  Your concern about "getting permission" and "getting sued" worries me and many others about your motives.

My first choice is Option #5 (lingcod w/ crossed rod & paddle) which would look great on apparel and as stickers.

My second choice is Option #3 (skeleton man) which would be great as an online banner or bumper sticker.

I voted for the ling too, but I also love the skeleton for the same reasons, plus they are both one color, and a cheap color at that.

The main reason I am asociated with this site and the people in it is because we seem to have each others back. None of us are here to put a knife in it. If I forget something on a trip, someone comes through to cover my @ss and visa versa. We share EVERYTHING HERE, rigs, techniques, whatever  .. ( significant others excluded of course  )
When I tell ANYONE about NCKA the main point I drive into them is that the people here are by far the coolest group of people I have ever associated with.
If I fall off my kayak I will GUARENTEE my homie will be right there to assist me and will not be thinking 'lawsuit' if anything goes amiss.
I understand there are A.H.'s out there who will jump at the opportunity for litigation. I can assure you if they were on this site they would be collectively black balled. Maybe even black and blue balled!
I do see a problem if we choose the all blue logo as one of the guys from The Blue Man Group might claim infringement. But then again, those guys don't talk so I think we would be fine!!!!

I have been in the advertising business for over 20 years, and I am very informed about copyright usages and using someone else's picture (or their likeness), in any kind of advertisement, poster, banner, sticker etc. whether that be for profit, or for nonprofit. It is illegal to use someone else's design, part of their design, or their image without their written permission which stipulates the exact nature in which it will be used for. While others may not be aware of the ramifications of doing this, I am.

I emailed JTF a release form a couple of weeks ago, to get his written permission to use his likeness in a number of my designs, including item number 7.  Since JTF did not respond nor send me back the release form, I assumed JTF was uncomfortable using his image in the NORCAL design. Therefore, item number 7 can not be used.

I wrote Bill an email several weeks ago, stating that if JTF did not give me his written permission, I could alter the design, so he would not be identifiable, but the three designs of mine that were selected did not have JTF in them, so it wasn't a problem with any of the designs of mine that were chosen.

Unfortunately, item #7 was one of my designs, that Marimite made modifications to, that is of JTF's likeness, and I am unable to modify it so it must not be used.

My motive is I don't want to be sued, nor do I want Bill to be sued by JTF.  If JTF sues Bill because Bill doesn't have his written permission to use his image in the NORCAL logo, then Bill could turn around and sue me if I gave him permission to use it.

None of the other three designs bare anyone's likeness in the design so they can be used.

Scwafish, I assumed when JTF didn't sign my release form he didn't want to, for what ever personal reason he may have had, so therefore I am not comfortable allowing Bill to use any of my designs with JTF's likeness.  I don't understand, your outburst, nor do I care to.

Sky - bottom line here is that John aka JTF will NOT sue Bill and Bill will not sue you. Like Mike / Tote mentioned earlier, we know each other well enough to be considered "family" and this "being sued" thing is not in our dictionary. This is how NCKA rolls 

....but then again, If I really needed the money, I would have sued Randall / Bigfoot for hiring his son to put a pig's head inside my kayak's hatch

So unless I have written permission from JTF to use his likeness, number seven can not be used. I am not willing to put myself, nor Bill, in that position.

How about this, if that design wins I will get JTF drunk and make him sign. No reason for him to sign before we decide on what logo we are even going to use.

I am going to guess that JTF didn't sign your release because, like most of us, he saw no need to do so.  

For the record, I am usually a friendly melow person, but your on/off hot/cold monkey business is a giant buzz kill, and somebody needs to say what the silent majority is thinking.

let's just scratch design number 7 = no big deal....life goes on.

That being said, I change my vote to #5.

Hell Bill if that Logo gets picked after you get him drunk I know what a fisherman needs next and that would be my treat..... besides if you take the glasses off the image on number 7 the image would look exactly like the invisible man but then the copyright for that film might be infringed also. For that matter what about the rights of the ling cod has anyone stood up for it's rights? KISS with emphasis on the second S.

If you know JTF, why don't you ask him to sign the release form and mail it to me, and the problem can easily be resolved.
