Great book on the subject of firearms/ Your freedom is sold at Western sports in Marin called How to own a gun and stay out of jail by John Machtinger.
According to this book, if you take a pop at anyone or anything with a flare gun, its the same as using a gun and you can be charged accordingly. Of course if you have a 15 foot shark on your ass, better safe than sorry .
